The reversal of Roe v. Wade has left many people wondering if state laws surrounding abortion will also apply to fertility treatments like IVF and embryo freezing. Dr. Kaylen Silverberg recently spoke to KUT 90.5, Austin’s NPR Station, about this topic.

Texas House Bill 1280 bans all abortions in Texas with two exceptions. Those exceptions being “in the extreme cases of saving a mother’s life or a major bodily function that is ‘aggravated’ by the pregnancy.” This so-called trigger law will go into effect at the end of July.

Dr. Silverberg has been working with several legal and industry experts to determine whether the bill’s language applies to IVF embryos in the lab or in frozen storage. These experts, including those at the American Society for Reproductive Medicine (ASRM) believe that the answer is no. They believe that, although these laws are drastically changing reproductive rights, they do not apply to IVF embryos.

Further adding to the peace of mind of Dr. Silverberg’s patients is the fact that Texas Fertility Center stores its patients’ frozen embryos in Las Vegas. There, they are subject to Nevada laws, which allow for abortion.

However, it is important to know that the new Texas law does likely apply to selective reduction in a pregnancy with multiples.
